Lawsuit Against Avril Lavigne Has Slight Chance

Avril Lavigne A lawsuit filed Wednesday against Canadian rock singer Avril Lavigne may have a slight chance of succeeding, according to lawyer, Dave Steinberg. The 70's pop duo 'The Rubinoos' filed a lawsuit against Avril Lavigne claiming her song, "Girlfriend" sounds too similar to their 1977 song, "I Wanna Be Your Boyfriend." The Rubinoos song has the lyrics and chorus "Hey, hey, you, you, I wanna be your boyfriend," while Avril's song has the lyrics "Hey, hey, you, you, I don't like your girlfriend."

Dave Steinberg, an entertainment lawyer, told Canada AM, "Copyright infringement is really about the melody and or the lyrics. And in this case I'm hearing some similarities between the two." He added, "There's definitely a similar look and feel between the two compositions. I don't know that there's enough there for copyright infringement however."

Avril Lavigne's manager, Terry McBride, denys that her song "Girlfriend" was copied from "The Rubinoos," saying, their song itself is similar to The Rolling Stones' "Get off of My Cloud".

Lavigne has no current plans of settling the lawsuit but will weigh the costs of defending the lawsuit against the costs of settling.

The Rubinoos lawyer, Nicholas Carline, said, "She's made a lot of money off of my client's song."

So the Stones and the Rubinoos have the same chords in that chorus.. Avril chorus at least are different chords.

yeah but the Rubinoos didn't sing hey hey you you I wanna be your cloud or hey hey you you get off of my boyfriend.

Whoever printed this story is using the wrong line of Avrils song to compare. It is very misleading. What she does is a lot worse than that.

She actually has a line in the chorus where says hey hey you you I wanna be your girlfriend.

not simply, i don't LIKE your girlfriend. I will agree that line is different.

But the line used in Avril's chorus over and over is identical to the Rubinoos with the exception of the gender for obvious reasons.

Avril can't perform live, can't write her own music and I have no idea how she got a record deal.Not all of our generation is fooled by these so called artists these labels are signing. So her writer babysitter guy got caught stealing a song for her to sing.The songs are identical.He thought that no one would remember this band from the 70's and that they would not resurface to claim whats theirs.She's made herself look worse by denying it.She's not talented enough to write anything.Get a clue people.

Avril doesn t need to steal songs, because is a good songwriter. She got a record deal for her singing talent.
